2. GENERAL CONDITIONS OF SALE
2.1 PURPOSE
These General Terms and Conditions of Sale are intended to define the rules applicable to the sale of our products ("hereinafter "the Product(s)") on our online store. They thus regulate the different stages of placing the order, the sale and the delivery of our products. More generally, they establish the rights and obligations of each of the parties.
2.2 ACCEPTANCE OF CONDITIONS
Order and acceptance. Placing an order constitutes acceptance by the customer, which results in the formation of the contract and the customer's definitive acceptance of the prices and description of the products available for sale as well as all the general terms and conditions of sale.
Non-commercial use. The acquisition of these products is exclusively reserved for personal use and not in connection with the customer's professional activity.
Confirmation of the order. After the order has been placed and therefore these conditions have been accepted, a confirmation of receipt of the order detailing the products ordered will be sent by email to the address indicated by the customer.
Availability of products. The products offered on the site are in principle all available and immediately deliverable. In the event of unavailability of one of the products, the buyer will be informed as soon as possible by Luciole & Petit Pois, by e-mail or telephone. The buyer will have the option of choosing another product offered on the site or canceling their purchase.
Our product offers are valid while stocks last, in mainland France, French overseas departments and territories, Corsica and abroad.
Description of products. Each product offered on the site is the subject of a descriptive sheet which, in addition to the photograph, contains: the price, the color, the dimensions as well as the particular characteristics if applicable.
It is specified that the photographs accompanying the product description sheet have only an indicative value due to the alterations that may exist due to their transcription on the site and that there may be a difference between the product as displayed on the screen and the product received, due to the different resolutions and settings.
2.3 DELIVERIES
Delivery address. The products are delivered to the address indicated by the customer when ordering in France or abroad.
Delivery costs. Delivery costs for France and International are automatically mentioned on your order form.
Delivery time. Delivery times are approximately 1 week in France and 15 days abroad.
Condition of the goods. The consumer is required to check the condition of the packaging of the goods upon delivery and to report any damage caused to the carrier on the delivery note, as well as to Luciole & Petit Pois, within one week.
Shipping method. Shipping will be carried out:
– For mainland France and overseas , with the Lettre Max, Colissimo or Petit Paquet Prioritaire International service from La Poste. Your order will be prepared within an indicative period of 24 to 72 hours. As soon as it is posted, we will send you a confirmation email indicating the references necessary for tracking on the La Poste website. If you are not at home, you can collect your package from your post office. The maximum total time is approximately 1 week.
– For international, with the Colissimo International or Petit Paquet Prioritaire International service from La Poste. The delivery times then depend on the country concerned.
2.4 SHIPPING COSTS
Shipping costs depend on the country the order is being sent to. Shipping costs are charged in addition to the price of the selected products.
For all shipments to Metropolitan France, shipping costs are free for orders over €30.
2.5 RIGHT OF WITHDRAWAL, EXCHANGES AND REFUNDS
Return of exchanged or refunded items. If an item does not suit you, you can exchange it or request a refund within 15 days of receiving your order ( excluding promotions and sales ).
To do this, simply return the item to us in perfect condition, in its original packaging, to the following address:

Return costs. Return costs are your responsibility. Reimbursement is made either by bank transaction on the card that paid for the order, or by check made out to the cardholder. In the event of an exchange, you do not pay a new flat-rate contribution to the shipping costs.
Condition for returning products. The return of products can only be accepted for products in their original condition, i.e. not stained, washed or damaged.
2.6 CONFIDENTIALITY
In accordance with the “information technology and freedoms” law of January 6, 1978, the information requested from the customer is essential for processing his order and the customer has a right of access and rectification to the data concerning him. This data will not be transmitted to any external organization.
2.7 PRICE
Prices. All prices indicated on the site are in Euros including VAT.
There is no minimum order amount.
The price indicated on the individual product sheets does not include transport. These costs depend on your order and are mentioned on your delivery note.
Taxes. In the context of direct import of products from mainland France, for countries outside the European Union and the French overseas departments and territories, import taxes may be requested from the customer by the local customs service, depending on the amount of the package. For more information, the customer must inquire with the customs services of the post office in their country.
2.8 PAYMENTS
Payment methods. We accept payments by credit card (Carte Bleue, Visa, Mastercard) via Paypal.
Payment methods such as bank transfer and cash on delivery are not accepted.
Debit. The invoice amount will be debited from your account at the time of your order.
If one or more products could not be delivered to you, the corresponding amount will be credited to you again within 24 hours.
Order validation. The order validated by the customer will only be considered effective when the bank payment centers have given their agreement, which will be subject to our agreement.
In the event of refusal by the said centres, the order will be cancelled and the customer notified by email, so that another payment method can be offered. Luciole & Petit Pois reserves the right to refuse any order from a customer with whom there is a dispute.
2.9 PAYMENT SECURITY
For payment security, we use the 100% secure Paypal payment system.
With this system, your card number is protected and encrypted.
You do not have to create a Paypal account, you fill out the Paypal form then pay using your bank card.
2.10 RESPONSIBILITY
Luciole & Petit Pois cannot be held liable for any inconvenience or damage relating to the use of the Internet, such as a breakdown in service, the presence of computer viruses or external intrusions or, more generally, any cases deemed to be force majeure by the courts.
